This Privacy Policy describes the information we collect from you and how we use that information.  It applies to information we collect on our website (www.mossberg.com) (the “Website”) and from your communications with us.

Please read this Privacy Policy carefully and completely.  If you do not agree with this Privacy Policy, our practices and policies regarding the use of your information, or the Terms & Conditions of our Website, please do not use or access the Website. By visiting or using our Website, you acknowledge and agree that you have read and understand this Privacy Policy and consent to the use of information as described in this Privacy Policy. This Privacy Policy, and any updates or revisions to it, will be prominently displayed on, and accessible from, our Website. Our Website is not intended for use by individuals located in the European Union (EU) or European Economic Area (EEA). 

Our Website is intended for a general audience and is not intended to be used or accessed by individuals under 18 years of age.  We do not knowingly collect personal information about individuals under the age of 18.  If we become aware that we have been provided information about an individuals under the age of 18, we will delete that personal information from our records.  

Please note that special terms and conditions apply to individuals who are residents of the states of California or Virginia as indicated in Sections 6 and 7 of this Privacy Policy. As a result, certain provisions of this Privacy Policy may not apply to you.


2. INFORMATION WE COLLECT AND HOW WE USE IT

A. When you visit our Website, we use automatic data collection technologies to track certain information.  We use this information to administer the Website and analyze its usage in order to deliver the best possible experience to you.

Examples of information we may track for these purposes include:

  • Your Internet protocol (IP) address.
  • The kind of Internet browser you use and the kind of computer or device you use to access the Website.
  • The number of links you click within the Website.
  • Your geographic location.
  • The date and time of your visit to our Website.

In addition to cookies, we may also use electronic images that are sometimes referred to as pixel tags, web beacons, or single-pixel GIFs.  These images allow Mossberg to count users who have visited certain pages and to deliver co-branded services.  Mossberg may also include these images in promotional e-mail messages or newsletters in order to determine whether messages have been opened and acted upon.

Some of these images may be placed by third-party service providers to help determine the effectiveness of our advertising campaigns or email communications.  These images may be used by these service providers to place a persistent cookie on your computer or device.  This allows the service provider to recognize your computer or device each time you visit certain pages or emails and compile anonymous information in relation to those page views, which in turn enables us and our service providers to learn which advertisements and emails bring you to our Website and how you use our Website.  Mossberg prohibits these images from being used to collect or access your personal information.

Some of your activity on our Website is conducted through Google Analytics.  You may review Google Analytics’ privacy policies here: https://support.google.com/analytics#topic=1008008.  We may also use other providers for analytical data regarding our Website from time to time. Additionally, Mossberg reserves the right to engage in other activities, such as sharing aggregated site statistics with third-parties or permitting other companies to place cookies through our Website, in order to deliver the best possible experience to you.

C. We also collect personal information you provide to us.

Information you provide to us that we collect includes:

  • Information you provide to us by completing forms, questionnaires, or notices on our Website, or contacting us through our Website, sending us emails, or communicating with us directly. This includes information provided when you register for an account, make purchases, request information or services from us, submit service requests, or opt-in and consent to receive communications from us concerning, among other things, news about Mossberg and our products and services. For example, we may request personal identifiers, such as: your name, age (birthdate), gender, company name, mailing and billing addresses, e-mail address, phone number, and zip code. We may also ask you for information when you enter a contest or promotion sponsored by Mossberg, and when you report a problem with our Website.
  • Records and copies of correspondence, including e-mail addresses if you contact us.
    Information you provide to us and details of transactions or purchases you engage in through our Website, such as purchases through the Mossberg Store, the fulfillment of your orders, firearm serial numbers, and repair records.  When you make a purchase, we will request some information, including personal information, such as your name, address, email address, and telephone number, as well as financial and/or credit card information, which may be forwarded to your credit card provider or a third-party processor.  We may also ask you to provide personal information to provide you support regarding our products or services.
  • Information you provide when you submit a search query on our Website.
  • Information you provide to us when you access our facilities or properties.  We require visitors to our facilities and properties to provide a valid, government-issued photo identification document. Such documents will include your likeness (photograph), and may also include your name, age (birthdate), gender, mailing address, business address, employer, identification number (such as license or passport number), biographical information (such as height, weight, eye color, hair color, fingerprints, etc.), and signature.
  • Please note, we are not responsible for maintaining or ensuring the accuracy or completeness of your information, including your personal information.  It is your responsibility to update your personal information and to ensure it is complete and accurate.  You can inform us of changes or inaccuracies to your personal information by emailing us at [email protected].

 


3. HOW WE USE PERSONAL INFORMATION

We collect information based upon the performance of our services at your request, such as the fulfillment of purchases or service requests you have made, our legitimate interests, and your consent, where applicable.

We may disclose personal information under certain circumstances, including:

  • To subsidiaries and affiliates, to the extent permitted under applicable laws.
  • To third parties (e.g., vendors and hosting companies) to provide the software, hardware, storage, networking, and other necessary technology required to provide high quality products and services to you through our Websites.

  • For any other lawful or legitimate purposes, including, with your consent, where applicable.

  • You can review, update, or change certain personal information you have provided to us by accessing your account through the Website;
  • You may review and adjust your communication and data preferences by accessing our Privacy Center or contacting us at [email protected], e.g., you can opt-out and unsubscribe from our email list, in which case you will no longer receive emails from us regarding new products, news about Mossberg, and other items of interest;
  • You may request additional information about whether we store or process any of your personal data; and
  • Certain states permit residents to obtain certain information from us regarding our disclosure of personal information to third-parties where the disclosure is for direct marketing purposes. Where we are using your personal information on the basis of your consent, you are entitled to withdraw that consent at any time. Where we process your personal information based on a legitimate interest, you may object at any time to that use of your personal information.

Please note, regardless of whether you opt-out or unsubscribe from communications, or withdraw consent regarding direct marketing, we may continue to contact you concerning other matters where we have a lawful or legitimate basis to do.

Please note that our policy is to retain certain data under specific circumstances for a period time pursuant to our retention polices, e.g., where you make a service request or make a purchase. However, as noted above, via the Privacy Center, you can request that we remove data you have provided to us by consent, e.g., upon request, we will delete your email address so that you will no longer receive marketing communications from us, such as communications about new Mossberg products.  You may continue to receive emails from us, however, where it is necessary for us to do so in order to fulfill other obligations, or where we have a lawful or legitimate basis to do so, e.g., service requests or order fulfilment.


6. PRIVACY RIGHTS OF CALIFORNIA RESIDENTS

The California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), provides California residents with specific rights regarding their personal information and sensitive personal information.  This section describes the rights of California residents under the CCPA and explains how to exercise those rights. 

A. Our Collection and Use of Personal Information

You have the Right to Know what personal information we may have collected about you within the last 12-months. As a general matter, within the 12-months preceding the most recent update of this Privacy Policy, we may have collected the following categories of personal information about you:

  • Identifiers, such as your first and last name, gender, e-mail address, and phone number;
  • Customer Records Information, such as your billing and mailing addresses, transaction history, and repair records;
  • Financial Information, such as credit or debit information, or any other payment information you provide us; and

We do not collect any Sensitive Personal Information as that term is defined under the CCPA.

In the last 12 months as of the most recent update to this Privacy Policy, we have not sold personal information about consumers, including, but not limited to, personal information of minors under eighteen (18) years of age.

During any given 12-month period, we gather personal information from the categories listed above, and will disclose these categories of personal information to a consumer upon receipt of a verifiable consumer request.

This personal information may be used to verify your identity, to create an account through our Website, for administrative purposes, to bill you for a service offered by the Website, to correspond with you regarding a request, inquiry, or purchase you have made, and to otherwise correspond with you.  You may provide this information to us voluntarily by filling out forms on our Website, creating an account, making purchases, entering contests or promotions, or by similar methods or means.

B. Our Disclosure of Personal Information to Third-Parties

In the last 12 months as of the most recent update to this Privacy Policy, we may have disclosed your personal information outlined in Section 6(A) above to third-party service providers to fulfill the following purposes:

C. Individual Rights of California Residents

   (i) Right to Access Information Collected

You have the right to request access to any personal information that we may have collected, used, disclosed, and sold about you over the past 12 months.  Once we receive and confirm your verifiable consumer request, we will disclose to you:

  •  The categories of personal information we collected about you in the preceding 12 months.
  • The categories of sources for the personal information we collected about you,
  • Our business or commercial purpose for collecting or selling that personal information,
  • The categories of third parties with whom we share that personal information,
  • The categories of personal information that we sold in the previous 12 months, and for each category identified, the categories of third parties to which it sold that particular category of personal information (however, please note, Mossberg does not sell personal information),
  • The specific pieces of personal information we collected about you (also called a data portability request),

If we disclosed your personal information for a business purpose, we will disclose to you the personal information categories that the recipient obtained.

(ii) Right to Deletion of Information Collected

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions.  Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.  We shall inform you whether or not we have complied with your request. 

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech or exercise another right provided for by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation; or
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

(iii) Right to Correct Information Collected

You have the right to request that we correct any inaccurate personal information that we collected from you and retained, subject to certain exceptions.  Once we receive, verify, and approve your request, we will correct (and direct our service providers to correct) your personal information, unless an exception applies.  We shall inform you whether or not we have complied with your request.

(iv) Right to Opt-Out of Sharing of Information Collected

You have the right to opt out of the sharing of your personal information to a third-party for data analytics.  Please note, we do not sell your personal information. We may share some personal information with other companies, as described above.

D. Exercising Rights and Submitting Verifiable Requests

If you are a California resident and would like to exercise the rights described above, please submit a verifiable consumer request to us by either:

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. 

You may only make a verifiable consumer request for access or data portability twice within a 12-month period.  The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, and
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Under the CPRA, you may exercise these rights yourself or you may designate an authorized agent to make these requests on your behalf.  We may request that your authorized agent have written permission from you to make requests on your behalf and may need to verify your authorized agent’s identity.

E. Responding to Verifiable Requests

We will confirm receipt of a verifiable request and provide information about how the request will be processed.  We will locate the requested personal information, and, if available, will take the requested action with regards to your verifiable request.  We endeavor to respond to a verifiable consumer request within a reasonable time of its receipt.  We may deny a request if we cannot verify the consumer.  If we require more time, we will inform you of the reason and extension period in writing. 

Any disclosures we provide will only cover the 12-month period preceding receipt of the verifiable request.  The response we provide will also explain the reason(s) we cannot comply with a request, if applicable.  For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.  If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.


7. PRIVACY RIGHTS OF VIRGINIA RESIDENTS

The Virginia Consumer Data Protection Act (VCDPA) provides Virginia residents with specific rights regarding their personal information.  This section describes the rights of Virginia residents under the VCDPA and explains how to exercise those rights. 

A. Individual Rights of Virginia Residents

Virginia residents have the right to:

  • Confirm whether or not Mossberg processes your personal information;
  • Access your personal information processed by Mossberg;
  • Correct inaccuracies in your personal data processed by Mossberg;
  • Delete your personal data processed by Mossberg;
  • Obtain a copy of your personal data processed by Mossberg; and
  • Opt out of the processing of your personal data for purposes of targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer (please note, Mossberg does not process any personal data for these purposes).

(i) Right to Access and Obtain a Copy of Personal Information

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 month period.  Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you in the preceding 12 months,
  • The categories of sources for the personal information we collected about you,
  • Our business or commercial purpose for collecting or selling that personal information
  • The categories of third parties with whom we share that personal information,
  • The categories of personal information that we sold in the previous 12 months, and for each category identified, the categories of third parties to which it sold that particular category of personal information (however, please note, Mossberg does not sell personal information),
  • The specific pieces of personal information we collected about you (also called a data portability request),
  • If we disclosed your personal information for a business purpose, we will disclose to you the personal information categories that the recipient obtained.

You may exercise your right to obtain a copy of the personal information processed by Mossberg twice in a single 12-month period.  If your request to obtain a copy of the personal information is verified and approved, we will provide the information free of charge no more than twice in a single 12-month period.

(ii) Right to Correct Inaccurate Personal Information Processed by Mossberg

You have the right to request that Mossberg correct any inaccurate personal information that we collected from you and retained, subject to certain exceptions.  Once we receive, verify, and approve your request, we will correct (and direct our service providers to correct) your personal information, unless an exception applies.  We shall inform you whether or not we have complied with your request. 

(iii) Right to Delete Personal Information Processed by Mossberg

You have the right to request that Mossberg delete any of your personal information that we collected from you and retained, subject to certain exceptions.  Once we receive, verify, and approve your request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.  We shall inform you whether or not we have complied with your request. 

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  •  Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

Only you or an authorized individual may make a verifiable consumer request related to your personal information. 

You may only make a verifiable consumer request for access or data portability twice within a 12-month period.  The verifiable consumer request must:

Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.

Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.    

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

C. Responding to Verifiable Requests

We will confirm receipt of a verifiable request as soon as practicable and provide information about how the request will be processed.  We will locate the requested personal information, and, if available, will take the requested action with regards to your verifiable request.  We endeavor to respond to a verifiable consumer request within a reasonable time of its receipt.  We may deny a request if we cannot verify the consumer.  If we require more time, we will inform you of the reason and extension period in writing.

8. NON-DISCRIMINATION

We will not discriminate against you for exercising any of your rights under the CCPA, VCDPA, or other applicable data privacy laws.  Unless permitted by the CCPA, VCDPA, or other data privacy laws, we will not do any of the following based upon your decision to exercise your rights under the CPRA, VCDPA, or other data privacy laws:

  • Deny you goods or services;
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
  • Provide you a different level or quality of goods or services; or
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

9. COLLECTION OF PERSONAL INFORMATION FROM APPLICANTS AND EMPLOYEES

If you apply for a job with Mossberg, we may request professional and employment-related information, education information, financial information, personal identification numbers, such as your driver’s license or social security number, personal health information, characteristics of protected classifications under California or federal law, and biometric information. If you are accepted for employment, other relevant personal information will be collected from you and included in your personnel file, along with any personal information collected during the application process. More information regarding the collection of personal information from applicants and employees is provided during the application process.


10. DATA SECURITY & STORAGE

We have implemented appropriate technical and organizational measures to ensure that your personal information is safeguarded in a commercially reasonable manner to prevent the accidental or unlawful destruction, theft, misuse, loss, or alteration of your personal information and the unauthorized disclosure of, or access to, your personal information. We cannot, however, guarantee that our safeguards are impenetrable.

We work with our third-party vendors to ensure that those vendors also implement commercially reasonable measures to safeguard and protect your personal information.

Unfortunately, the transmission of information via the Internet is not completely secure and we cannot guarantee the security of your personal information transmitted to our Website.  Any transmission of personal information is at your own risk.  We are not responsible for the circumvention of any privacy settings or security measures contained on the Website.

Your personal information is stored and processed in the United States and is not transferred outside of the United States. We retain your personal information only as long as is reasonably necessary and proportionate to achieve the business purpose for which the information was collected or processed, or to otherwise comply with an applicable statutory or regulatory requirement.
